The data controller is HappyVore, a simplified joint-stock company (SAC), registered with the Paris Trade and Companies Register (RCS) under No. 880 710 223, with its principal place of business located at 50 rue Saint-Lazare, 75009 Paris (hereinafter“We”).

2. What personal data do we collect?

Personal data is data that can be used to identify an individual.

We collect data that falls into the following categories:

  • Identification information: including your last name, first name, mailing address, email address, cell phone number, and company name; 
  • Login information: including your username and password;
  • Information about your order
  • Information about your credit cards.

Required fields are indicated when you provide us with your information. They are marked with an asterisk and are necessary for us to provide you with our services.

3. On what legal basis(es), for what purpose(s), and for how long do we retain your personal data?

Purposes of Data Processing Legal Basis Retention Periods

Process your order and handle customer management tasks related to orders, deliveries, invoices, and customer relationship management 
Performance of a contract you have entered into
Personal data is retained for the duration of the contractual relationship plus a period of 3 years following the end of that relationship. In addition, your personal data (with the exception of your banking information) is archived for evidentiary purposes for a period of 3 years.     Regarding data related to your credit card: For one-time payments: the data is retained until full payment is received. For installment payments: the data is retained until the final payment is due. Data related to the security code (CVV2) printed on your credit card is not stored. 
  Data related to your credit cards may be retained for evidentiary purposes in the event of a dispute over the transaction and stored in an interim archive for a period of 13 (thirteen) months following the debit date. This period may be extended to 15 (fifteen) months to account for the possibility of deferred-debit payment cards.

In addition, the data may be archived for evidentiary purposes for a period of 3 years.

If your application is unsuccessful, we may wish to retain your data; if so, we will notify you.
Unless you object to such retention of your data, we will retain it for 2 years from the date of your last contact.

To provide the services available on our Site (to create and access your account for the purpose of placing orders for our products)

Data is retained for the entire duration of your account, plus a period of 3 years following the deletion of your account.

For prospects: Data is retained for 3 years from the date of your last contact.

Our legitimate interest in publishing your recipes and sharing them with our community
 Personal data is retained for 3 years. 

To be contacted so that we can serve our products at your establishment or sell our products to you

The data is retained for as long as necessary to process your request for information and is deleted once the request has been processed.
Manage Requests to Exercise Rights
 Comply with our legal and regulatory obligations 
 If we ask you to provide proof of identity: we retain it only for as long as necessary to verify your identity. Once the verification is complete, the proof is deleted. If you exercise your right to object to receiving marketing communications: we retain this information for 3 years. 

4. Who receives your personal data? 

The following individuals will have access to your personal data:

  1. Our company's staff;
  2. Our subcontractors: the hosting provider; our payment service providers; the lead management tool provider; the newsletter distribution provider; our logistics provider 
  3. Our partners: the delivery provider for your orders;
  4. If applicable: Public and private organizations, solely to fulfill our legal obligations.

5. Is there a possibility that your data will be transferred outside the European Union?

Your data is retained and stored for the entire duration of the processing on Shopify’s servers within the European Union and/or in Canada.

As part of the tools we use (see Article 4 on recipients regarding our processors), your data may be transferred outside the European Union. 

The transfer of your data in this context is secured using the following tools:

  • Alternatively, this data is transferred to a country that has been deemed by a decision of the European Commission to provide an adequate level of protection;
  • Alternatively, we have entered into a specific contract with our subcontractors governing the transfer of your data outside the European Union, based on the standard contractual clauses between a data controller and a data processor approved by the European Commission;
  • Alternatively, we rely on the appropriate safeguards provided for in the applicable regulations.

6. What are your rights regarding your data?

You have the following rights regarding your personal data:

  • Right to information: that is precisely why we have drafted this policy. This right is provided for in Articles 13 and 14 of the GDPR.
  • Right of access: You have the right to access all of your personal data at any time, pursuant to Article 15 of the GDPR
  • Right to rectification: You have the right to have your inaccurate, incomplete, or outdated personal data corrected at any time, in accordance with Article 16 of the GDPR.
  • Right to restriction of processing: You have the right to obtain the restriction of the processing of your personal data in certain cases set forth in Article 18 of the GDPR.
  • Right to erasure: You have the right to request that your personal data be erased and to prohibit any future collection of such data for the reasons set forth in Article 17 of the GDPR.
  • The right to file a complaint with a competent supervisory authority(in France, the CNIL) if you believe that the processing of your personal data violates applicable laws. (Article 77 of the GDPR)
  • The right to establish guidelines regarding the retention, deletion, and disclosure of your personal data after your death,in accordancewith Article 40-1 of the French Data Protection Act.
  • Right to withdraw your consent at any time: For processing based on consent, Article 7 of the GDPR provides that you may withdraw your consent at any time. Such withdrawal will not affect the lawfulness of processing carried out prior to the withdrawal.
  • Right to data portability: Subject to certain conditions specified in Article 20 of the GDPR, you have the right to receive the personal data you have provided to us in a standard, machine-readable format and to request that it be transferred to the recipient of your choice.
  • Right to Object: Under Article 21 of the GDPR, you have the right to object to the processing of your personal data. Please note, however, that we may continue to process your personal data despite your objection, for legitimate reasons or to defend our legal rights.
