CONTEST RULES

Article 1: Organization

LES NOUVEAUX FERMIERS SAS, a simplified joint-stock company with a capital of €11,543.80, hereinafter referred to as “the Organizer,” with its registered office located at 59 RUE SAINT LAZARE, 75009 PARIS, registered under RCS PARIS number 880 710 223, is organizing a free contest with no purchase necessary, running from June 16, 2023, through September 17, 2023, at midnight (including the last day).

Article 2: Participants

This free game, with no obligation to purchase, is open exclusively to individuals who are of legal age as of the game's start date and who reside in metropolitan France (excluding Corsica).

Persons who do not meet the above conditions are excluded from the contest, as are employees of “the Organizer,” and any person who has directly or indirectly participated in the design, production, or management of the contest, as well as their spouses and family members: direct lineal relatives and other relatives, whether or not they live in the same household.

"The Organizer" reserves the right to ask any participant to provide proof of compliance with the conditions set forth above. Any person who does not meet these conditions or refuses to provide proof of compliance will be excluded from the contest and, if a winner, will not be eligible to receive their prize.

Only one entry per person is allowed (same name, same address). “The organizer” reserves the right to verify compliance with this rule.

Participation in the contest implies full acceptance of these rules.

Article 3: Terms and Conditions of Participation

Participants must pick up a form available at the HappyVore booth, fill it out, and then drop it into the designated box.

Participants must complete the information form fully and accurately for their registration to be validated. Players acknowledge and agree that the information entered in the registration form serves as proof of their identity.

Any entry submitted in violation of these rules will be deemed invalid. Any participant suspected of fraud may be disqualified from the contest by “the Organizer” without the Organizer being required to provide an explanation. Any entry that is incomplete, incorrect, or illegible—whether intentionally or not—or submitted in a format other than that specified in these rules will be considered void. The same penalty will apply in the event of multiple entries.

Article 4: Winnings

The prizes are distributed as follows:


• 1st through 5th prizes: 1 Cabaia backpack + 1 Barbeuc' Heureux Kit - 3 kg (€140.95, tax included)

• 6th through 10th prizes: 1 Cabaia backpack + 1 “Barbeuc’ Heureux” kit – 3 kg (€140.95, tax included)

• 11th prize: 1 electric griddle + 1 “Barbeuc’ Super Heureux” kit – 7 kg (€218.95, tax included)


Total amount: €1,628.45, including tax.

The value of the prizes is determined at the time this regulation is drafted, and their valuation may not be contested.

All expenses incurred after the contest, including those related to the maintenance and use of these prizes, are the sole responsibility of the winner.

Article 5: Selection of Winners

Winners will be selected through several random drawings:


• On the following dates: June 17, 2023; July 1, 2023; July 8, 2023; July 23, 2023; September 10, 2023; September 18, 2023


Eligibility requirements for the prize drawings:

Two drawings will be held on the following dates: June 17, 2023; July 1, 2023; July 8, 2023; July 23, 2023; and September 10, 2023, for a chance to win one of two prizes: a "Cabaia Backpack + A 'Barbeuc' Heureux' Kit - 3 kg."
Then, on September 18, 2023, there will be a random drawing among all participants for the prize: "An electric griddle + a 'Super Heureux' Barbecue Kit - 7 kg."

Article 6: Announcement of Winners

Winners will be notified by email at the address provided when they entered the contest.

Article 7: Prize Distribution

Prizes will be mailed to the mailing addresses provided by the participants.

If a return is not delivered, the prize will remain available to the participant for 15 days. After that time, the participant will no longer be entitled to it.

Winners agree to accept the prizes as offered, without the option to exchange them—including for cash, other goods, or services of any kind—or to transfer the prize to a third party. Similarly, these prizes may not be the subject of any claims for compensation.

"The Organizer" reserves the right, in the event of circumstances beyond its control—including those related to its suppliers or unforeseeable circumstances—to replace the announced prizes with prizes of equivalent value. The winner will be notified of any changes.

Article 8: Use of Participants' Personal Data

Participants' information is collected and used by “the organizer” to record their participation in the contest and to facilitate the awarding of prizes.

Participants may, for legitimate reasons, object to the processing of their personal data provided in connection with this contest. They also have the right to object to the use of their personal data for marketing purposes outside the scope of this contest, a right they may exercise upon registering for the contest by writing to “The Organizer” at the address provided in Article 1.

The winner(s) authorize “the Organizer” to use their contact information (last name, first name) for advertising or public relations purposes in any medium whatsoever, without this entitling them to any compensation, right, or benefit whatsoever, other than the awarding of their prize.

In accordance with the latest version of the French Data Protection Act, as well as Regulation No. 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), the participant may exercise their right of access, rectification, erasure of data, restriction of processing, data portability, objection, and the right to withdraw consent by writing to “the Organizer” at the address specified in Article 1.

Article 9: Game Rules

The contest rules are on file with SELARL ACTA - PIERSON et ASSOCIES, a judicial officer’s office located at 15 rue de Sarre, P.O. Box 15126, 57074 METZ Cedex 3.

The contest rules will be available at happyvore.com/jeu-concours-tournee.

It may be sent free of charge to anyone who requests it from “the organizer.”

“The Organizer” reserves the right to extend, shorten, modify, or cancel the contest at any time, particularly in the event of force majeure, without participants being entitled to any compensation. The rules, as amended by any addendum(s), will be filed, if applicable, with SELARL ACTA - PIERSON et ASSOCIES, a judicial officer’s office located at 15 rue de Sarre, BP 15126, 57074 METZ Cedex 3.

Article 10: Industrial and Intellectual Property

The reproduction, display, or use of all or any part of the game's components, including these rules, is strictly prohibited.

All trademarks, logos, text, images, videos, and other distinctive signs displayed on this website, as well as on websites accessible through hyperlinks from this website, are the exclusive property of their respective owners and are protected worldwide by the provisions of the Intellectual Property Code. Unauthorized reproduction of these materials constitutes infringement and is subject to criminal penalties.

Any unauthorized reproduction, in whole or in part, of these trademarks, logos, and symbols constitutes infringement and is subject to criminal penalties.

Participation in this contest implies participants' full and unconditional acceptance of these rules.

Article 11: Liability

"The Organizer" shall not be held liable in the event of force majeure or unforeseeable circumstances beyond its control.

“The Organizer” shall not be held liable for any delays, losses, thefts, or damage to mail, or for illegible postmarks resulting from the actions of the postal services. Nor shall it be held liable, and no legal action may be brought against it, in the event of circumstances constituting force majeure (strikes, severe weather, etc.) that partially or completely prevent participants from taking part in the contest and/or winners from receiving their prizes.

"The Organizer," along with its service providers and partners, shall in no event be held liable for any incidents that may occur in connection with the use of the prizes by the winners or their guests once the winners have taken possession of the prizes.

Similarly, “The Organizer,” as well as its service providers and partners, shall not be held liable for the loss or theft of prizes by the winners once the winners have taken possession of them. Any additional costs incurred in taking possession of the prizes are the sole responsibility of the winners, who may not seek any compensation from “the Organizer,” its service providers, or its partners.

Article 12: Disputes and Claims

These Terms and Conditions are governed by French law.

“The Organizer” reserves the right to make a final and binding decision on any dispute that may arise regarding the interpretation or application of these rules, it being understood that no disputes will be accepted—in particular regarding the contest terms, results, prizes, or their receipt—one month after the end of the contest. Except in cases of obvious errors, it is agreed that the information generated by the Organizer’s contest systems shall be deemed conclusive evidence in any dispute regarding connection details and the computer processing of said information related to the contest.

Any complaints must be submitted to “the Organizer” within one month of the contest’s end date. After this date, no complaints will be accepted. Participation in the contest constitutes full acceptance of these rules.

Article 13: Evidence Agreement

By express agreement between the participant and “the Organizer,” the “Organizer’s” computer systems and files shall be the sole basis of proof.

The electronic records stored in the “Organizer’s” computer systems, under reasonable conditions of security and reliability, are considered proof of the interactions and communications that have taken place between the “Organizer” and the participant.

It is therefore agreed that, unless there is a manifest error, “The Organizer” may rely on—in particular, for the purpose of proving any act, fact, or omission—the programs, data, files, records, operations, and other elements (such as monitoring reports or other statements) of a computer-based or electronic nature, in any format or medium, created, received, or stored directly or indirectly by “The Organizer,” particularly within its computer systems.

The items in question thus constitute evidence, and if they are submitted as evidence by “the Organizer” in any litigation or other proceeding, they shall be admissible, valid, and enforceable between the parties in the same manner, under the same conditions, and with the same probative value as any document that would be drawn up, received, or retained in writing.

Any transactions of any kind carried out using the username and password assigned to a participant upon registration are irrefutably presumed to have been carried out under the participant's responsibility.
